If you don’t make the decision to appoint an attorney to deal with your assets and money, or personal care and welfare, while you can, someone else could make the decision when you can’t.

HOW WE CAN HELP

We help individuals and families to make applications under the Protection of Personal and Property Rights Act 1988 for the appointment of property managers and welfare guardians, and to review existing orders.

Where issues come up about the management of someone’s else’s property or decisions being made, we help to seek reviews through the Family Court. Where appropriate, we can seek to have enduring powers of attorney revoked and an independent manager and welfare guardian appointed. We also assist corporate clients and charitable trusts that own and operate rest homes to ensure care fees are paid.

If a person needs full-time residential care, we help with the application for financial means assessment, including advice about eligibility. The existence of family trusts and gifting can complicate this, and we understand how the issues have been treated by the Ministry of Social Development. We can also assist with Residential Care Loans for those who still own the family home but whose cash assets are under the threshold.
